Amendment to New York State Pay Transparency Law

On March 3, 2023, Governor Kathy Hochul signed legislation amending New York’s pay transparency law.

The amendment clarifies that a job, promotion, or transfer opportunity is covered by the pay transparency law if the position reports to a supervisor, office, or other work site in New York. In other words, the pay transparency law’s requirements extend to out-of-state positions that report into New York. Its basic requirement is that job advertisements by New York employers must disclose the pay (or pay range) and position description (if there is one) for jobs, promotions, or transfer opportunities.

The pay transparency law, as amended, goes into effect on September 17, 2023.
